Rob -- thanks for highlighting. My sense is that, if one takes Prof. Volokh's statement as representative, libertarian and (at least many) Catholic perspectives on this issue, though not necessarily in disagreement as to the bottom line, might part company at step 3 of the analysis. For that matter, what EV describes as the conservative position might well differ at step 3, though for somewhat different reasons.
